What To Do If You Accidentally Shoplifted

You might scoff at the idea that someone could “accidentally shoplift” – until you mistakenly do it yourself. Maybe you had a lot on your mind while you were shopping and simply forgot to go through the checkout line. Or maybe you were shopping with your kids and failed to notice the youngest slipping a small item into your pocket or purse. Whatever the case, you may now find yourself facing retail theft charges over an honest mistake.

Illinois Attitude on Marijuana Possession Is Slowly Shifting

Illinois has historically taken a hard line when it comes to marijuana possession, but as the national attitude towards pot shifts, legislators in our state are slowly pushing for change. Now, three bills that would effectively decriminalize possessions of small amounts of marijuana are under consideration.

Here’s what you need to know about those three proposals:

What Constitutes Disorderly Conduct in Chicago?

You’re likely already familiar with the term “disorderly conduct” and may have heard it applied to a wide variety of activities. Possible Defenses in a Chicago Public Indecency Case

If you’re being charged with public indecency, you may wonder what the big deal is—perhaps you urinated in an alley after a night at the bars or mooned an old college friend as a joke, and you don’t believe that your actions should be considered a criminal offense. Unfortunately, the arresting officer probably didn’t see things this way, and you need to take any charge leveled against you very seriously.

Under Illinois state law 720 ILCS 5/11-30, public indecency [...]

Nonviolent Drug Offenders May See Early Release Soon

It’s no secret that the United States’ prisons are overpopulated with offenders serving time for nonviolent drug crimes. Now, however, the US Sentencing Commission is seeking to address that problem through an early release proposal. The proposal, which the Sentencing Commission passed earlier this month, will make over 46,000 current inmates eligible for early release starting in November 2015. As this policy is gradually phased in, it should cut the average prison sentence by about 25 months.

The Difference Between Assault and Aggravated Assault in Illinois

Aggravated Assault | Assault

In Illinois, the line between assault and aggravated assault often comes down to the presence of aggravating factors. While both offenses involve actions that place someone in fear of immediate harm, aggravated assault includes elements that make the conduct more harmful. If you are faced with an assault charge, a Chicago criminal defense lawyer can explain these distinctions and their consequences. The legal team at the Law Offices of Andrew Weisberg can assist you in separating the two cases and [...]
