Nonviolent Drug Offenders May See Early Release Soon

It’s no secret that the United States’ prisons are overpopulated with offenders serving time for nonviolent drug crimes. Now, however, the US Sentencing Commission is seeking to address that problem through an early release proposal. The proposal, which the Sentencing Commission passed earlier this month, will make over 46,000 current inmates eligible for early release starting in November 2015. As this policy is gradually phased in, it should cut the average prison sentence by about 25 months.

When Retail Theft Accusations Are Rooted in Racial Profiling

The majority of white shoppers probably don’t give too much thought to walking into a store and passing a security officer. However, many African-Americans and other people of color have a different experience. In some cases, black shoppers have even been accused of or charged with retail theft for items that they legally purchased.

Financial dependence, immigration status, fear of making the situation worse, and fear of losing custody over the kids are all potential reasons that often come up in conversations about domestic violence. There is, however, another reason that isn’t always as clearly articulated: the importance our society places on two-parent households.

Police Can No Longer Search Your Cell Phone without a Warrant

As a Chicago drug lawyer, I’ve seen plenty of cases where defendants’ cell phones have gotten them into more trouble than they bargained for. It is far from unheard of for an individual to get pulled over for something relatively minor only to find themselves behind bars because other incriminating evidence was found either in their car or on their person. Sometimes, a cell phone—and a police officer’s unwarranted search of that cell phone—is to blame.

However, according to [...]

3 Popular Assault Myths, Debunked

There’s a divide between the common perception of assault and its definition under Illinois criminal law. As a result, some defendants are surprised to find that their actions have resulted in an assault charge and are unsure what, if anything, they can do to avoid a conviction.

In order to clarify this often confusing charge, I’m going to discuss three of the most common assault myths that I encounter as a Chicago assault lawyer.

What is Criminal Trespass Under Illinois Law?

Criminal Trespass

Think you’re not trespassing? Illinois law might say otherwise. It doesn’t take a break-in or a locked gate. Just being in the wrong place or staying too long can lead to criminal charges. Maybe you thought you had permission. Maybe you didn’t realize it was off-limits. Either way, a trespass charge is serious. It can follow you for years and show up on background checks.

That’s why it’s smart to call the Law Offices of Andrew Weisberg, a seasoned Chicago, [...]

Illinois Expungement Laws: Can You Clear Your Record?

Expungement / Sealing Records

A past arrest or charge—even one that didn’t lead to a conviction—can stick with you for years. It can show up in background checks, cost you job opportunities, or affect where you live.

Thousands of people in Illinois live with records that no longer reflect who they are. Expungement offers a chance to clear your name—but the process isn’t automatic or easy. That’s where the Law Offices of Andrew Weisberg, a respected Chicago, IL criminal defense attorney, can step in [...]
