<h2 class="wp-block-heading">What Is Criminal Sexual Abuse in Illinois?</h2>

Under Illinois law, <a href="/blog/ways-you-can-be-charged-with-aggravated-criminal-sexual-abuse-in-il/">criminal sexual abuse</a> is a crime that is similar to criminal sexual assault but just slightly different. Criminal sexual abuse does not involve penetration but instead involves criminal sexual conduct crimes where the threat of force or force is used such as molestation.</p>


<p>When a child is the victim of these crimes, it’s clear that they can legally not consent to it or were forced to engage in the act. That makes this crime a Class 4 felony in Illinois. If a person is convicted of a Class 4 felony for this crime, then they can be sent to prison for up to three years. But if the accused has prior convictions on their criminal record, then they can be sentenced to as many as seven years in prison upon conviction.</p>


<p>One part of the law that is interesting to note is that criminal sexual abuse can involve penetration, but only in cases where it is perpetrated by a minor. For perpetrators that are under the age of 17 with victims between the ages of 9 and 16 or victims between 13 and 16 with perpetrators who are less than five years their senior, this crime can be charged. However, it’s often considered a Class A misdemeanor in these cases, which can result in up to 12 months of imprisonment.

<h2 class="wp-block-heading">Aggravated Criminal Sexual Abuse</h2>


<p>
<a href="https://www.ilga.gov/legislation/ilcs/fulltext.asp?DocName=072000050K11-1.50" rel="noopener noreferrer" target="_blank">Criminal sexual abuse</a> can also be an aggravated <a href="/blog/is-il-sex-with-a-minor-a-crime-if-you-dont-know-their-age/">crime</a>. That means that aggravating factors are a part of the case, which can drive the crime up to a Class 2 felony and make the penalties even higher – up to seven years imprisonment.</p>


<p>Aggravating factors in these cases include things such as:

<li>A victim younger than 17 with a family member as the perpetrator</li>
<li>A victim between 9 and 16 who is abused by the threat of force or by force</li>
<li>A victim who is under age 12 with the age of the perpetrator being 17 or higher</li>
<li>A victim 8 or younger and a perpetrator who is under the age of 17</li>
</ul>

<h2 class="wp-block-heading" id="h-sex-offender-registration-in-illinois">Sex Offender Registration in Illinois</h2>



<p>
The state of Illinois has something called the Sex Offender Registration Act. If you meet the requirements, you must register as a <a href="/blog/what-does-it-mean-to-be-an-il-sex-offender/">sex offender</a> in the state. The requirements are:

Sexual offenders must register for a period of 10 years, but how long can vary from case to case. Sexual predators must register for the rest of their lives.

<p><a href="https://www.ilga.gov/legislation/ilcs/ilcs4.asp?DocName=072000050HArt%2E+11+Subdiv%2E+25&ActID=1876&ChapterID=53&SeqStart=20300000&SeqEnd=21000000" rel="noopener noreferrer" target="_blank">Grooming</a> is perpetrated when someone uses the internet or other online service to solicit, entice, seduce, or lure a child or their guardian into committing a sexual offense or unlawful sexual conduct. It is also considered grooming if photos that transmit sexual organs are involved.</p>


<p>This <a href="/blog/accused-of-an-il-sex-crime-heres-what-to-do/">crime</a> is a bit of an all-encompassing crime due to the way it is carried out. It prohibits someone from using technology to solicit a child to engage in any type of sex offense. This can include crimes such as:

<li>Predatory criminal sexual assault of a child</li>

Indecent solicitation of a child occurs when someone over the age of 17 authorizes, requests, urges, advises, incites, or commands a child knowingly to perform acts involving sexual penetration or engage in sexual conduct.</p>


<p>Someone can also be charged with this crime if they knowingly discuss sexual conduct or sexual penetration with someone under 17. This applies to someone the perpetrator believes is a child, too – not simply a child.</p>

The level of a felony a person is charged with in connection with this crime depends on the sexual offense that results.</p>


<p>For example, someone guilty of criminally sexual assaulting a child would be charged with a Class 1 felony for solicitation. In contrast, internet discussions of solicitation with a child can be a Class 4 felony. Every level of a felony may also include fines of as much as $25,000 in addition to time in prison. <h2 class="wp-block-heading">What Does It Mean to Possess Child Pornography?</h2>


<p>
Under the law in Illinois, you cannot legally have in your <a href="https://www.ilga.gov/legislation/ilcs/documents/072000050k11-20.1.htm" rel="noopener noreferrer" target="_blank">possession</a> materials that depict child pornography such as videos or photos.</p>

<h2 class="wp-block-heading">Aggravated Sexual Assault: What Is It?</h2>


<p>
<a href="/blog/ways-you-can-be-charged-with-aggravated-criminal-sexual-abuse-in-il/">Aggravated criminal charges</a>, including sexual assault, are simply more severe charges that can be added to a case when the circumstances warrant it. In order for aggravated sexual assault to be charged, sexual assault must occur in conjunction with at least one of the following acts:

<li>The victim has a physical disability</li>
<li>The person who committed the sexual assault gave the victim a controlled substance without their knowledge or consent</li>
<li>A firearm was in possession of the perpetrator</li>
<li>A firearm was discharged during the crime</li>
</ul>


<p>
<a href="https://www.ilga.gov/legislation/ilcs/fulltext.asp?DocName=072000050K11-1.30" rel="noopener noreferrer" target="_blank">Aggravated sexual assault</a> is considered a Class X felony in Illinois, which is the most serious type of felony a person can face. If convicted of sexual assault that is aggravated in the state, a person can face up to 30 years behind bars and be ordered to pay as much as $25,000 in fines.</p>


<p>However, mandatory prison sentencing can come into play if there are other circumstances present in the case, such as threatening the victim with a dangerous weapon. In that case, an additional 10 years is added automatically to the prison sentence imposed by the court.</p>

<h2 class="wp-block-heading"><strong>The Penalties for Sex Trafficking</strong></h2>


<p>
In Illinois, it is a crime to knowingly transport, obtain, provide, harbor, recruit, or entice a person to be subjected to sexual servitude. Sex trafficking in the state of Illinois is, under most circumstances, a Class 1 felony.</p>


<p>However, it becomes a Class X felony, the most serious in the state, if there are any of these conditions involved:
</p>


<ul class="wp-block-list">
<li>Attempted kidnapping or kidnapping</li>
<li>Attempt to commit or the commission of an aggravated criminal sexual assault</li>
<li>The attempt of first-degree murder</li>
</ul>

<p>If a person is convicted of a Class 1 felony, they can face up to 15 years in prison and be required to pay as much as $25,000 in fines.</p>


<p>For Class X felonies, the penalties include up to 30 years in prison and fines of $25,000.</p>

<p>It’s also important to note that you don’t have to transport anyone for an offense to be considered <a href="https://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=2812&ChapterID=57" rel="noopener noreferrer" target="_blank">sex trafficking</a>. The victim may stay in the same place. The key is simply that sex trafficking is defined as subjecting someone to sexual servitude, no matter where they are.

<h2 class="wp-block-heading">The Penalties for Sex Trafficking In Illinois</h2>


<p>
It is a Class 1 felony in the state of Illinois to <a href="/blog/human-trafficking-in-illinois-it-isnt-always-about-sex/">sex traffick another person</a>. If convicted of this level of crime, you can face as many as 15 years behind bars. If there are aggravating factors in the case, then you can face a Class X felony, the most serious level of felony in the state, which can send you to prison for many years.</p>


<p>What types of things are considered aggravating factors? Common ones include:

<p>In Illinois, sex abuse is a topic that has been discussed in the public sphere for quite some time. Some loopholes in the law, as well as big cases in the media, have spurred the legislature to act. As a result, we have new legislation called Faith’s Law.</p>



<p>Also know as House Bill 1975, <a href="https://www.wifr.com/2021/12/03/faiths-law-shines-light-teachers-who-groom-students/#:~:text=(WIFR)%20%2D%20Governor%20JB%20Pritzker%20signed%20Faith's%20Law%20on%20Friday.&text=Faith's%20Law%20expands%20the%20definition,third%20party%2C%20or%20written%20communication." rel="noopener noreferrer" target="_blank">Faith’s Law</a> is named for a student who experienced sexual abuse at the hands of a trusted adult. This law now legally defines what it means to groom a child for sexual abuse. Furthermore, it requires that schools put in safeguards to protect their students.</p>



<p>Faith’s Law took effect at the start of 2022. Here’s what you need to know about it and how it changes the laws in the state.
</p>



<h2 class="wp-block-heading" id="h-how-is-grooming-now-defined-by-law">How Is Grooming Now Defined by Law?</h2>



<p>
The concept of “<a href="https://www.ilga.gov/legislation/ilcs/ilcs4.asp?DocName=072000050HArt%2E+11+Subdiv%2E+25&ActID=1876&ChapterID=53&SeqStart=20300000&SeqEnd=21000000#:~:text=(a)%20A%20person%20commits%20grooming,a%20child%2C%20a%20child's%20guardian%2C" rel="noopener noreferrer" target="_blank">grooming</a>” is central to <a href="https://www.centralillinoisproud.com/news/local-news/pritzker-signs-faiths-law-what-this-means-for-schools-and-what-local-organizations-have-already-been-doing/" rel="noopener noreferrer" target="_blank">Faith’s Law</a>, which works to expand how grooming is defined under Illinois law. Grooming is now defined as occurring when someone knowingly uses the internet, computer, or any electric transmission or storage device in order to lure, entice, seduce, solicit, or attempt to do any of those things to a child under the age of 17.</p>



<p>It’s also important to note that it is now illegal for anyone to gain access to a child for abuse by seducing the person who is or who is believed to be their guardian. Additionally, it is illegal to seduce a child to commit offenses under the Illinois Sexual Registration Act. This includes taking photos of the sex organs of a child or engaging in any other types of behavior that can be construed as grooming.</p>



<p>It is now illegal under Faith’s Law to <a href="/blog/sex-between-il-minors-consensual-conduct-or-criminal-sexual-abuse/">seduce</a> a child through a third party, written communication, or sex acts in person, not simply through online means. That is one important loophole that this law has closed.
</p>



<h2 class="wp-block-heading" id="h-other-changes">Other Changes</h2>



<p>
There are a few other changes to the law under this bill, namely the increase of resources for those who have survived sexual abuse and their families.</p>



<p>Schools in Illinois are also now required to create a code of conduct that outlines sexual misconduct in the school. Staff who work in education must have their employment history thoroughly reviewed to scope out any incidents of sexual abuse that may have occurred in the past. Sexual abuse training is also expected to be expanded for those working in education.</p>



<p>Also, new boundaries will be set by school districts for maintaining professional relationships with students and setting proper boundaries. Now there will be distinct guidelines for:
</p>



<ul class="wp-block-list">
<li>The transportation of students</li>



<li>Meeting with students outside of the professional role of educators</li>



<li>Having or taking photos of a student</li>
</ul>



<p>
If an employee commits any violations of the policy set by the schools under the new law, then it is grounds for termination of employment, as well as other disciplinary actions.</p>



<h2 class="wp-block-heading" id="h-what-are-the-penalties-in-illinois-for-grooming">What Are the Penalties in Illinois for Grooming?</h2>



<p>
If a person is <a href="/blog/what-does-it-mean-to-be-an-il-sex-offender/">convicted</a> under the statutes of this new law for grooming, then they will face the penalties for a Class 4 felony. That is punishable by up to three years in prison, but grooming can also be paired with other charges that will increase the penalties, such as sexual assault or child abuse.</p>

<p>Statutory rape, sexual assault, aggravated sexual assault, rape, and unlawful sexual intercourse are just a few of the crimes that can be committed by unsuspecting teens in relationships. In many places, Romeo and Juliet laws are in place to help reduce the consequences for teens in situations where they are close in age but one is still considered a legal adult. In Illinois, however, these laws are limited.</p>


<p>It’s vital to understand what the laws in Illinois say about teens in consensual sexual relationships so that you don’t become the star of your own tragic story.
</p>


<h2 class="wp-block-heading">Age of Consent in Illinois</h2>


<p>
In the state of Illinois, 17 years old is considered the age of consent. That means that anyone under the age of 17 is legally unable to consent to sex even if the act is voluntary – or even if they initiate it. Having sex with someone under the age of 17 is considered a sex crime.
</p>


<h2 class="wp-block-heading">Does Illinois Have Statutory Rape Laws?</h2>


<p>
Though most people may casually refer to having sex with someone under the age of consent as <a href="https://www.criminaldefenselawyer.com/resources/illinois-statutory-rape-laws.htm" rel="noopener noreferrer" target="_blank">statutory rape</a>, there are actually a few crimes in Illinois that can be prosecuted if someone has sex with someone under the age of consent. These crimes are:
</p>


<h3 class="wp-block-heading"><em><strong>Criminal Sexual Abuse</strong></em></h3>


<p>
This is a law referring to sexual conduct which includes acts such as fondling or touching for the purpose of sexual gratification.</p>


<p>This is a Class A misdemeanor, punishable by up to 12 months in prison and fines of as much as $2,500.
</p>


<h3 class="wp-block-heading"><em><strong>Criminal Sexual Assault</strong></em></h3>


<p>
This <a href="/blog/the-three-tiers-of-criminal-sexual-assault-in-illinois/">crime</a> occurs when there is <a href="https://www.ilga.gov/legislation/ilcs/fulltext.asp?DocName=072000050K11-1.50" rel="noopener noreferrer" target="_blank">sexual penetration</a>, which is considered sexual contact between the sex organs or anus of two people or between an object, mouth, or anus of another. This includes acts such as anal sex, fellatio, and cunnilingus.</p>


<p>This is a Class 1 felony, punishable by up to 15 years in a penitentiary and as much as $25,000 in fines.
</p>


<h3 class="wp-block-heading"><em><strong>Aggravated Criminal Sexual Abuse</strong></em></h3>


<p>
This occurs when there is <a href="/blog/ways-you-can-be-charged-with-aggravated-criminal-sexual-abuse-in-il/">criminal sexual abuse</a> through sexual conduct that uses the <a href="/blog/what-makes-my-illinois-sex-crime-charges-aggravated/">threat of force</a> or force or with a victim who is known to lack the capacity to give consent. It is can also be perpetrated if the person over 17 is in a position of authority over the victim.</p>


<p>This is a Class 2 felony, which can result in up to seven years behind bars and fines of as much as $25,000.
</p>


<h3 class="wp-block-heading"><em><strong>Predatory Criminal Sexual Assault</strong></em></h3>


<p>
This crime occurs in the same way as aggravated criminal sexual assault, except that the victims are often younger – under 13 – and a firearm is used in the commission of the crime. It can also occur if the victim sustains great bodily injury that is life-threatening or results in permanent disability.</p>


<p>Being found guilty of this crime can land you in prison for up to 60 years since it’s considered a Class X felony, the most serious, in Illinois.
</p>


<h2 class="wp-block-heading">What About Romeo and Juliet Laws?</h2>

<p>In some cases, a person over 17 who has sexual contact or sex with someone under 17 can face one of the above charges. You hear frightening stories of someone who was 19, for example, dating someone who was 16 and being charged with criminal sexual abuse that required registration as a sex offender for 10 years. Or stories of those who are 17 having relationships with 15-year-olds that sour – then they are charged with a crime for sex they considered consensual.</p>


<p>In Illinois, there is a limited exception for criminal sexual abuse under <a href="http://ilvoices.org/uploads/3/4/1/6/34164648/fact_sheet_-_romeo_and_juliet.pdf" rel="noopener noreferrer" target="_blank">Romeo and Juliet</a> standards. The conduct itself is still illegal, but reduced time in prison and smaller fines can result.</p>

<p>The ubiquitous presence of phones and computers in children’s lives has created new social questions for parents, schools, and lawmakers.</p>


<p>One detective in <a href="https://wsiltv.com/2021/04/15/illinois-representatives-unanimously-approve-sexting-education-bill/" rel="noopener noreferrer" target="_blank">Illinois</a> found that 60% of “sextortion” online comes from peers, not strangers. The other 40%? It comes from internet gaming.</p>


<p>As if that wasn’t terrifying enough, state and national legislation have struggled to keep up with this unusual legal territory.</p>


<p>Initially, states used standard child pornography laws to charge sexting cases. However, the felony penalties often felt overzealous and unnecessarily harsh in the face of children texting each other.
</p>


<h2 class="wp-block-heading">A New Approach in Illinois</h2>


<p>
House representatives in Illinois have approved House Bill 24 to go to the Senate Floor, which would require a sexting segment in any Illinois school with a sex education program. In other words, it wouldn’t require sex education in general, but it would require current curriculums to add information about sexting.</p>


<p>How does this change fit into current laws that address sexting between minors?
</p>


<h2 class="wp-block-heading">Current Illinois Sexting Laws</h2>


<p>
Nationwide, sexting is often prosecuted under child pornography charges. This requires a convicted person to register as a sex offender as part of their punishment.</p>


<p>Many states, however, have softened their laws in the case of minors. Illinois forms part of that group. Our state charges minor sexting cases under <a href="https://www.ilga.gov/legislation/ilcs/documents/070504050K3-40.htm" rel="noopener noreferrer" target="_blank">juvenile supervision laws</a>, which allows the defendants to avoid a delinquency record and sex offender registration.</p>


<p>But the legal definition is still quite narrow. If they choose, prosecutors can prosecute sexting by minors under harsher laws.
</p>


<h2 class="wp-block-heading">What Exactly Is Sexting Between Minors?</h2>


<p>
“<a href="https://www.isba.org/ibj/2010/04/sextingitsnojokeitsacrime" rel="noopener noreferrer" target="_blank">Sexting</a>” occurs when “indecent visual depictions” of external genitalia, pubic area, buttocks, or female breasts are sent to or requested from someone via digital means. That could mean using a phone, laptop, tablet, or computer.</p>


<p>It’s generally understood that a minor is a person under age 18. The reduced penalties for sexting only apply when both parties are under age 18.</p>


<p>A good rule of thumb to teach minors: would this part of your body be covered by a bathing suit? Then think twice about photographing and sharing it.</p>


<p>In general, sexting needs legal redress when:
</p>


<ul class="wp-block-list">
<li>Images are posted without the depicted person’s permission</li>
<li>Recipients did not request the image</li>
<li>The recipient and/or subject suffered emotional distress</li>
<li>The context of image sharing established a reasonable expectation of privacy</li>
</ul>


<p>
The danger of sexting is that no digital image remains private after you hit “send.” Even the most well-intentioned friends might accidentally share something.</p>


<p>It’s also been observed that many minors sext due to peer pressure, not because they actually want to do it. This can compromise the privacy and safety of their identity and body against their will. House Bill 24 would seek to educate students on these risks.</p>


<p>If minors are caught <a href="/blog/sexting-between-minors-is-a-crime/">sexting</a> — with or without permission from the sender or receiver — how does Illinois charge this?
</p>


<h2 class="wp-block-heading">Juvenile or Adult Court in IL</h2>


<p>
Minors who are accused of committing a crime typically go through the <a href="/blog/il-court-leniency-for-juvenile-crimes-only-goes-so-far/">juvenile justice system</a>. However, for minors age 13 and older, some cases will be <a href="https://www.criminaldefenselawyer.com/resources/criminal-defense/juvenile/who-decides-try-a-juvenile-adult" rel="noopener noreferrer" target="_blank">transferred to adult court</a> to face harsher penalties.</p>


<p>The judge decides what’s in the best interest of the minor: trying them in juvenile court or adult court.</p>

<strong><em>Juvenile penalties.</em></strong> In the case of minors <a href="/practice-areas/sexual-offense/">sexting</a> each other, Illinois will opt for less permanent, less confining penalties first. For instance, if a minor in Illinois is involved in the electronic dissemination of an indecent visual image, the court can order the minor to go to counseling or perform community service.</p>


<p>For a lighter offense, the minor defendant might be adjudicated under supervision rather than spending any time imprisoned. For more serious offenses, they might be forced to pay a fine, serve probation, or serve time in a juvenile facility.</p>


<p><strong><em>Adult penalties.</em></strong> An adult court conviction for child pornography or a similar crime will evoke more drastic penalties, including lengthy prison sentences, steep fines, and a felony record. In many cases, sex offender registration may also be required.</p>

<p>This is why consent plays such a huge role in sexual relations between adults. Still, sometimes mistakes of consent happen. <p>Here’s what you need to know about sexual consent – what it legally means in Illinois, plus the <a href="/blog/criminal-sexual-abuse-vs-sexual-assault-in-illinois/">charges</a> faced if you fail to get consent from another person.

<h2 class="wp-block-heading">The Role of Consent</h2>


<p>
Every state has its own definition of consent. In Illinois, “consent” means permission given freely for <a href="https://www.ilga.gov/legislation/ilcs/ilcs4.asp?ActID=1876&ChapterID=53&SeqStart=14900000&SeqEnd=16400000" rel="noopener noreferrer" target="_blank">sexual activity</a>.</p>


<p>When you have sexual relations with someone, they should feel free to say “yes” or “no” at any time during the encounter. No one should take submission, lack of physical/verbal resistance, silence, or passivity as consent.</p>


<p>A few factors play into legal consent if it’s in question. In relation to sexual acts, you should make sure that:
</p>


<ul class="wp-block-list">
<li>Consent is freely given – the person offered consent of their own free will. They were not threatened, coerced, or induced to consent through fraud.</li>
<li>Consent was affirmative – they expressed through words and overt actions that they agreed to the act.</li>
<li>The other person has the capacity to consent – they were legally able to do so.</li>
</ul>


<p>
Capacity to consent is a sticking point. The law considers some people without the capacity to consent, even if they give it affirmatively.</p>


<p>Factors that play into a person’s capacity to consent include:
</p>


<ul class="wp-block-list">
<li>Their age – in Illinois, anyone under age 17 is not considered legally able to give consent to participate in a sexual act with an adult.</li>
<li>Mental disability – if someone is developmentally disabled or suffers from another form of mental incapacitation, they are often viewed as legally unable to consent.</li>
<li>Physical disability – conditions that render a person physically helpless may also call into question their ability to consent.</li>
<li>Intoxication – an intoxicated person may not be able to legally give consent, either. Another hinge point: was their intoxication voluntary?</li>
<li>Consciousness – someone unconscious because they’re asleep, sedated, or suffering physical trauma, i.e. a concussion, cannot freely give consent.</li>
<li>Adults who are vulnerable – the vulnerable, like an ill or elderly person, may not be legally able to give their consent.</li>
<li>Power-imbalanced relationships – a person in a position of authority, like a correctional officer or a boss, cannot legally obtain affirmative consent from someone under them.</li>
</ul>


<h2 class="wp-block-heading">Sexual Assault Penalties in Illinois</h2>

<p>Illinois defines <a href="https://www.justice.gov.nt.ca/en/files/victim-services/Sexual%20Assault.pdf" rel="noopener noreferrer" target="_blank">sexual assault</a> as an act of sexual penetration perpetrated without consent, with force or the <a href="/blog/three-times-an-il-sex-crime-is-aggravated-without-a-weapon-involved/">threat of force</a>, or with victims under a certain age.</p>


<p>First-time offenders can be charged with a Class 1 felony, punishable by as many as 15 years in prison. After the first offense, the charge may jump to a <a href="/blog/your-guide-to-understanding-class-x-felonies-in-illinois/">Class X felony</a>, which can land you up to 60 years behind bars.</p>
