Illinois law defines the charge or offense of Assault (720 ILCS 5/12-1) as the act of unreasonably placing another person in apprehension of an imminent battery. An example would be a person attempting to punch another person in the face, even if they miss. For an assault charge, there need not be physical contact. It is enough for one person to make another person reasonably believe they are about to be struck.
The offense or charge of Battery, (720 ILCS 5/12-3), which is considered to be a separate crime in Illinois, is the act of knowingly causing physical harm to another person or making contact with that person that is either provoking or insulting.
The charge or offense of Domestic battery, (720 ILCS 5/12-3.2), is a battery committed against a family or household member. This includes husbands, wives, boyfriends, girlfriends, brothers, sisters, aunts, uncles or anybody living in the household. Although domestic battery is generally a misdemeanor offense, it is a more serious charge than “simple” battery because if convicted, can never be removed from a person’s record.
The assault and battery mentioned above are misdemeanor offenses that do carry a possibility of jail time. The maximum sentence for these offenses is up to 364 days in the county jail. These offenses do not carry the possibility of a prison sentence to the Illinois Department of Corrections. That being said, Illinois law provides numerous examples of assault and battery charges that are elevated to felony offenses and carry the possibility of prison time.

- Was carried out against a police officer, teacher, senior citizen, child or other protect class
- Involved a deadly weapon

The following are assault or battery charges and offenses that are considered to be felonies in Illinois:
Aggravated Domestic Battery (720 ILCS 5/12-3.3); Aggravated Battery (720 ILCS 5/12-3.05 or 720 ILCS 5/12-4); Heinous Battery (720 ILCS 5/12-4.1); Aggravated Battery with a Firearm (720 ILCS 5/12-4.2); Aggravated Battery of a Child (720 ILCS 5/12-4.3) and Aggravated battery of a Senior Citizen (720 ILCS 5/12-4.6).
The offense or charge of Aggravated Assault (720 ILCS 5/12-2) is a more serious version of the “simple” assault charge. With this offense, there are both misdemeanor and felony offenses depending upon status of the alleged victim and whether a weapon was used.
